Terms of Service

1. Acceptance of Terms
By accessing or using the RoastHive website at https://roasthive.com, the RoastHive dashboard, APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service.
These Terms constitute a legally binding agreement between you (or, if you are acting on behalf of an organization, that organization) and RoastHive. The word "you" refers to the individual or entity using the Service.
If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.
The Service is not available to persons or entities that have been previously suspended or removed from the Service, or to persons located in jurisdictions where the Service is prohibited by law.
3. Accounts
You must provide accurate, current, and complete information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at legal@roasthive.com if you become aware of any unauthorized access to or use of your account. RoastHive is not liable for any loss or damage arising from your failure to safeguard your credentials.
You may not share your account with others, create accounts by automated means, or create accounts under false or misleading pretenses.
4. Description of Service
RoastHive is a platform-as-a-service ("PaaS") that allows users to host and serve static websites. The Service enables you to upload, deploy, and manage static files accessible via a public URL.
RoastHive reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. RoastHive will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
5. Acceptable Use
You are solely responsible for all content you upload, publish, or otherwise make available through the Service ("Your Content"). You agree to use the Service only for lawful purposes and in a manner consistent with these Terms and all applicable local, national, and international laws and regulations.
The following is a non-exhaustive list of content and activities that are strictly prohibited on the Service:
Illegal content and activities
- Any content that violates any applicable law or regulation, including but not limited to copyright, trademark, trade secret, privacy, consumer protection, or export control laws.
- Content that facilitates or promotes illegal activities, including drug trafficking, human trafficking, money laundering, fraud, or identity theft.
- Content promoting or soliciting violence, terrorism, or extremism.
- Unauthorized collection, processing, or storage of personal data in violation of applicable data protection laws (including GDPR and CCPA).
Sexually explicit and exploitative content
- Any content that sexually exploits or depicts minors in any way, including child sexual abuse material (CSAM). Such content will be reported immediately to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement authorities.
- Pornographic, sexually explicit, or adult content of any kind is not permitted on the Service.
- Non-consensual intimate imagery or content designed to harass, stalk, or sexually exploit individuals.
Harmful and malicious content
- Malware, ransomware, spyware, viruses, trojans, or any other malicious code or software.
- Phishing pages, credential-harvesting sites, or content designed to deceive users into disclosing sensitive information.
- Content that impersonates RoastHive, another company, or any individual in a misleading or deceptive manner.
- Cryptocurrency mining scripts, cryptojacking, or any unauthorized use of visitors' computing resources.
Abusive and hateful content
- Content that promotes, glorifies, or incites hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, disability, or any other protected characteristic.
- Harassment, bullying, doxxing, stalking, or threatening content targeting any individual or group.
Spam and platform abuse
- Sending unsolicited bulk email, spam, or using the Service as part of a mass mailing operation.
- Creating sites purely for the purpose of search engine manipulation (link farms, doorway pages, etc.).
- Circumventing, disabling, or otherwise interfering with security features of the Service.
- Attempting to gain unauthorized access to any part of the Service, other users' accounts, or third-party systems through the Service.
- Excessive use of resources (bandwidth, storage, or requests) in a manner that degrades the Service for other users.
RoastHive reserves the right, but not the obligation, to monitor Your Content for compliance with these Terms. We may (but are not required to) review and remove any content that we determine, in our sole discretion, violates these Terms.

6. Fair Use and Resource Limits
The Service runs on shared infrastructure. To ensure a consistent experience for all users, the following fair-use principles apply regardless of plan.
High-traffic events
If your site receives a sudden, large surge in traffic (e.g., a viral event or press mention), RoastHive will make reasonable efforts to notify you at least 24 hours before throttling or suspending service where technically feasible.RoastHive will never charge you extra for unexpected traffic spikes — we will either continue serving your site or throttle it, but we will not send you a surprise invoice.
Commercial-scale usage
Sites that consistently receive millions of page views per month are expected to be on a plan whose resource allocation reflects that usage. If your site's bandwidth or request consumption persistently and materially exceeds your plan's included allocation, RoastHive reserves the right to require you to upgrade to an appropriate plan or, where no standard plan is suitable, to negotiate a custom arrangement. RoastHive will give you at least 14 days' notice before taking any such action.
Prohibited resource abuse
Regardless of plan, you may not deliberately generate artificial traffic (e.g., via bots, scripts, or click farms) to inflate bandwidth or request metrics, or to degrade the experience of other users.
No liability for throttling
RoastHive is not liable for any loss, damage, or lost revenue resulting from throttling, rate-limiting, or temporary suspension of a site, provided RoastHivehas made reasonable efforts to notify you as described above.
7. Your Content
You retain ownership of Your Content. By uploading content to the Service, you grant RoastHive a worldwide, non-exclusive, royalty-free license to host, store, serve, and reproduce Your Content solely to the extent necessary to operate and provide the Service.
You represent and warrant that: (a) you own Your Content or have the necessary rights to grant the license above; (b) Your Content does not infringe any third-party intellectual property rights; and (c) Your Content complies with these Terms and all applicable laws.
You are solely responsible for backing up Your Content. RoastHive does not guarantee that Your Content will be preserved in the event of account deletion, suspension, or service disruption.
8. Copyright (DMCA)
RoastHive responds to valid copyright infringement notices under the Digital Millennium Copyright Act ("DMCA"). If you believe content hosted on the Service infringes your copyright, send a notice to contact@roasthive.com containing:
- Your physical or electronic signature (or the signature of the authorized rights holder).
- Identification of the copyrighted work you claim has been infringed.
- The URL of the allegedly infringing content on the Service.
- Your contact information (name, address, telephone number, email).
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Repeat infringers will have their accounts terminated in accordance with our repeat-infringer policy.
9. Payment and Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are stated in euros (€) and are non-refundable except as expressly stated in these Terms or required by applicable law.
You authorize RoastHive (via its payment processor) to charge your payment method for all fees due. If a payment fails, we may suspend your account until payment is received.
We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing period — they take effect at your next renewal.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time, except where required by law.
Taxes (VAT, GST, or similar) may be added to your invoice based on your billing address and applicable law. You are responsible for any such taxes.
10. Termination and Suspension
RoastHive may suspend or permanently terminate your account and access to the Service at any time, with or without cause, and with or without notice, atRoastHive's sole discretion. Without limiting the foregoing, the following circumstances will typically result in immediate suspension or termination without notice:
- Violation of the Acceptable Use Policy (Section 5).
- Uploading or serving illegal content, CSAM, or content that poses a risk to minors.
- Conduct that RoastHive determines, in its sole discretion, is harmful to other users, third parties, or RoastHive.
- Non-payment of fees after a reasonable cure period.
- Any fraudulent, abusive, or deceptive activity in connection with the Service.
- A request from law enforcement or a government authority.
Upon termination, your right to access and use the Service ceases immediately.RoastHive may delete Your Content at any time following termination and has no obligation to retain or provide copies of Your Content.
If your account is terminated for a material breach of these Terms, you will not be entitled to any refund of prepaid fees.
You may terminate your account at any time by following the account deletion process in your dashboard or by contacting us at legal@roasthive.com.
Sections 7, 11, 12, 13, 14, 15, and 16 of these Terms survive any termination.
11. Intellectual Property
The Service and all of its components — including software, design, text, graphics, logos, and trademarks — are owned by RoastHive or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service or RoastHive's intellectual property other than the limited license to use the Service as described herein.
You may not reproduce, copy, distribute, modify, create derivative works of, publicly display, or reverse-engineer any part of the Service without prior written permission from RoastHive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE OPERATION.
RoastHive does not warrant that the Service will be available at all times, that it will be free from errors or interruptions, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.
Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions apply to the maximum extent permitted by applicable law.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROASTHIVE, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ROASTHIVE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO ROASTHIVE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) €100.
Some jurisdictions do not allow limitations on liability for certain types of damages. In those jurisdictions, RoastHive's liability is limited to the fullest extent permitted by applicable law.
14. Indemnification
You agree to indemnify, defend, and hold harmless RoastHive and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights or privacy rights.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Germany for the resolution of any disputes arising under these Terms, except where mandatory consumer protection law in your jurisdiction provides otherwise.
If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform.
Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such longer period as required by applicable law.
16. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
If you do not agree to the revised Terms, you must stop using the Service and cancel your account before the changes take effect.
17. General Provisions
- Entire agreement. These Terms, together with the Privacy Policy and any supplemental terms applicable to specific features, constitute the entire agreement between you and RoastHive regarding the Service and supersede all prior agreements.
- Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
- No waiver. RoastHive's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment. You may not assign or transfer any of your rights or obligations under these Terms without prior written consent from RoastHive.RoastHive may freely assign these Terms.
- Force majeure. RoastHive is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, war, terrorism, pandemic, government action, or internet infrastructure failures.
- No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
